NOTICE UNDER REGULATION 28(4)

SEVERN TRENT WATER: COOPERS GREEN WATER TREATMENT WORKS

THE SECRETARY OF STATE:

  1. received a report from Severn Trent Water (the “Company”) dated 25 November 2014 (the “Report”) which states that there is or has been a significant risk of supplying water from Coopers Green Water Treatment Worksthat could constitute a potential danger to human health.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Arsenic

Requirements

(a) to maintain the following measures for the period specified

  1. Monitoring by sampling of the levels of Arsenic in the final water.
    Date: Ongoing for the duration of the notice
  2. Compliance with local codified procedures for chlorination and catchment surveillance, including training of operational staff.
    Date: Ongoing for the duration of the notice
  3. Continue to operate existing treatment systems to optimise performance (blending for Arsenic risk).
    Date: Ongoing for the duration of the notice
  4. Regularly appraise risks and put in place increased monitoring or measures as appropriate.
    Date: Ongoing for the duration of the notice

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Develop a contingency plan to maintain wholesome supplies to be implemented in the event that arsenic levels are detected above the prescribed value in the final water.
    Date: 30 June 2019
  2. Complete feasibility study of the proposed Enhanced Water Treatment (EWT) solution.
    Date: 31 September 2020
  3. Confirm completion of design and expected start date for construction of the agreed solution.
    Date: 31 March 2022
  4. Complete construction and commissioning of the agreed solution.
    Date: 31 March 2025

(c) to audit whether the measures have been effective by the following means:

  1. Define a strategy for auditing the effectiveness of the above measures.
    Date: 31 March 2020
  2. Implement the audit strategy outlined in (c)1.

(d) not to supply water for regulation 4(1) purposes from Coopers Green Water Treatment Works unless the conditions specified below are satisfied

  1. Arsenic concentrations in the final water do not pose a potential health risk to consumers.
    Date: For the duration of this notice

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress report annually by 31 January and against the following milestones:
    • following the development of a contingency plan to maintain wholesome supplies in the event that arsenic levels are detected above the prescribed value in the final water.
      Date: 31 July 2019
    • confirmation of the appropriateness of the proposed solution and details of the strategy for auditing the effectiveness of the measures to be made operational.
      Date: 31 October 2020
    • confirm completion of design and expected start date for construction of the proposed solution.
      Date: 30 April 2022
    • confirm completion of construction and commissioning of the proposed solution.
      Date: 30 April 2025
  2. Review the risk assessment for Coopers Green Water Treatment Works as required by Regulation 27(4) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: 30 June 2025
  3. Submit a satisfactory completion report.
    Date: 30 April 2026

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Act. Further contravention of the regulation 28(4)(d) requirement in this Notice is an offence and a person guilty of the offence shall be liable on conviction to a fine.
