Details of this Notice:
- The Drinking Water Inspectorate (‘the Inspectorate’) has received a regulation 28(1) report of the Water Supply (Water Quality) Regulations 2016 (as amended) (‘the Regulations’) from the Company dated 07 February 2022, which states that there is or has been a significant risk of supplying water from Forston Water Treatment Works (and associated assets as applicable) that could constitute a potential danger to human health or could be unwholesome.
- Consequently, this Notice is served on the Company by the Inspectorate on behalf of the Secretary of State, under regulation 28(4) for the assets listed above, for risks associated with:

- The Company are required to satisfy the following requirements.
The date given is that until or by which the requirements must be maintained or satisfied, as appropriate.
Requirements:
(a) To maintain the following measures for the period specified in each case:
- Up to date Site Operating Manual and Site Specific Disinfection Policy defining normal operating ranges, triggers, response and contingency procedures with controlled update and review programmes
Date: Ongoing for the duration of this Notice - Ensure the works’ control and shutdown system is operational and that site monitors are calibrated at the predefined frequencies
Date: Ongoing for the duration of this Notice - Maintain and review site operating procedures and training documentation to ensure site operators and operational scientists required to make decisions on the operation of the site are conversant with its operation
Date: Ongoing for the duration of this Notice - Operation of all processes within defined operating ranges with appropriate triggers, responses and contingency procedures
Date: Ongoing for the duration of this Notice - Enhanced operational monitoring for microbiological faecal indicators / Cryptosporidium to validate that the site is operated according to the procedures. Any parameter detected outside acceptable limits is recorded and published on a daily exception report and investigated
Date: Ongoing for the duration of this Notice - Maintain water quality monitoring at points within the process in order to confirm ongoing compliance with the requirements of regulation 26, with appropriate controls in place to ensure any water deemed unsatisfactory (outside the shutdown criteria) to be captured within the asset and disposed of in a controlled manner
Date: Ongoing for the duration of this Notice - Continuously review all critical control points and mitigation measures with a view to updating the Notice with additional measures where required. Ensure that any new risk identified is assessed in accordance with the company’s Drinking Water Safety Plan (DWSP) methodology
Date: Ongoing for the duration of this Notice - Maintain contingency plans to protect human health in the event of a risk associated with drinking water quality. This should include liaison with local authorities and the United Kingdom Health Security Agency to agree any actions needed to protect human health and the issuing of advice to consumers, where required

(b) To review, revise or make operational the following measures, by the dates specified in each case:
- Undertake the design of a UV system at Forston WTW to ensure compliance with regulation 26
Date: 31 July 2022 - Complete installation and commissioning of a new, validated ultraviolet reactor, with an applied dose of 100mJ/cm2 to comply with the guidance on UV systems, issued by the Inspectorate
Date: 30 September 2023 - Complete a review of operational controls and automatic shutdown times prior to the completion of step (b)2
Date: Prior to completion of step (b)2 - Conduct a detailed review of the existing site control philosophy, control system hardware and telemetry. Integration of the existing control system and any new control system to form a single system compliant with the latest standards
Date: Prior to completion of step (b)2 - Train all relevant staff, update the site operating manual and Site Specific Disinfection Policy

(c) To audit whether the measures have been effective by the following means:
- Define an audit strategy to monitor the effectiveness of the measures specified in sections (a) and (b)
Date: 31 August 2022 - Implement, and keep under continuous review, the audit strategy defined in measure (c)1
Date: Following completion of measure (c)1. onwards.
(d) Not to supply water for regulation 4(1) purposes from Forston Treatment Works, or not to so supply unless the specified conditions below are satisfied:
- Not applicable
(e) To provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risks:
- Provide a progress report annually.
Date: by 31 January each year. - Provide the final design of the UV installation in step (b)1
Date: 31 August 2022 - Submit a report confirming completion of construction and commissioning of the UV installation, training of relevant staff and updated SOM and SSDP
Date: 31 January 2024 - Submit the strategy for auditing the effectiveness of the measures, as specified in (c)1
Date: 30 September 2022 - Submit any revisions of the audit strategy produced under measure (c)2
Date: Within 1 month of a revision - Submit a report in the event that any completed measure of this Notice needs to be altered in any way for any reason
Date: Ongoing for the duration of this Notice - Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with board level director sign-off
Date: 31 October 2024 - Submit the audit strategy for auditing the effectiveness of the measures, as specified in measure (c)1
Date: 30 September 2022 - Submit any revisions of the audit strategy produced under measure (c)2
Date: Within 1 month of a revision - Submit a report in the event that any completed measures of this Notice need to be altered in any way, for any reason
Date: Ongoing for the duration of this Notice - Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with Board level Director sign-off

Further Details of this Notice:
- Any product or substance used as a result of the requirements in this Notice must comply with regulation 31.
- Under regulation 28(6) the Inspectorate, on behalf of the Secretary of State, may by notice served on the Company, revoke or vary this Notice.
- Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991 (as amended).
