Details of this Notice:
- The Drinking Water Inspectorate (‘the Inspectorate’) has received a regulation 28(1) report of the Water Supply (Water Quality) Regulations 2018 (‘the Regulations’) from the Company dated 29 July 2022 (Court Farm treatment works) and 23 March 2023 (Monmouth treatment works), which states that there is or has been a significant risk of supplying water from Monmouth treatment works and Court Farm treatment works (and associated assets as applicable) that could constitute a potential danger to human health or could be unwholesome.
- Consequently, this Notice is served on the Company by the Inspectorate on behalf of the Welsh Ministers, under regulation 28(4) for the assets listed above, for risks associated with:

Requirements:
(a) To maintain the following measures for the period specified in each case:
- Regular review and update of catchment and abstraction risk assessments.

- Regular review and update of risk assessments associated with taste and odour, pesticide and pollution risks for Monmouth treatment works and Court Farm treatment works and downstream assets.

- Monitoring for taste, odour, and pesticides across the supply system according to company policies and procedures.

- Liaison with Public Health Wales and local authorities in the event of any breach of a health based standard or event trigger.

- Continuous online monitoring for deterioration in raw water quality (pH and turbidity plus any other parameter for which there is online monitoring at these sources) at the river Wye abstraction point, river Wye upstream of the abstraction point, and at Court Farm Impounding Reservoir.

- Continuous online monitoring for deterioration in raw water quality (pH and turbidity plus any other parameter for which there is online monitoring at these sources) at the inlet to Monmouth treatment works and Court Farm treatment works.

- Log and investigate any unusual odour detections at of the raw water at Monmouth treatment works and Court Farm treatment works.

- Log and investigate any unusual taste and odour detections at of the final water at Monmouth treatment works and Court Farm treatment works and in distribution.

- Operation of Monmouth treatment works, and Court Farm treatment works in accordance with Company policy, procedures and to internally agreed process parameters.

- Proactive management and optimisation of the treatment processes to improve removal of taste and odour, pesticides, organic carbon, and other pollution risks.

- Proactive management of Monmouth treatment works, and Court Farm treatment works and network to minimise taste and odour, pesticide, and pollution risks.

- Monitor and regularly review trends in consumer contacts in the Monmouth / Trellech water supply zone.

- Investigate any consumer contacts regarding taste and odour in the Monmouth / Trellech water supply zone.

- Monitor and regularly review trends of telemetry data and regulatory and operational sample results from the treatment works, service reservoirs and water supply zones. Investigate any result which above the company’s internal trigger value.

(b) To review, revise or make operational the following measures, by the dates specified in each case:
- Review and update the company policy for GAC treatment and identify, with scientific evidence and benchmarking, an appropriate minimum empty bed contact time (EBCT) for the risks associated with all possible raw water sources in the company asset base.

- Identify a solution to mitigate the risks from pollution, pesticides and taste and odour in the raw water source at Monmouth treatment works. Confirm solution.
Date: 31 March 2025
- Complete the planning, design, and procurement arrangements for the construction of the agreed solution.
Date: 31 March 2026
- Complete the construction, installation, and commissioning of the agreed solution.
Date: 31 March 2028
- Ensure staff are fully briefed and trained in operating new or modified process stages.
Date: 31 March 2028
- Identify a solution to mitigate the risks from pollution, pesticides and taste and odour in the raw water source at Court Farm treatment works. Confirm solution.
Date: 31 March 2024
- Complete the planning, design, and procurement arrangements for the construction of the agreed solution.
Date: 31 March 2025
- Complete the construction, installation, and commissioning of the agreed solution.
Date: 31 March 2026
- Ensure staff are fully briefed and trained in operating new or modified process stages.

(c) To audit whether the measures have been effective by the following means:
- Define an audit strategy to monitor the effectiveness of the measures specified in sections (a) and (b).

- Implement, and keep under continuous review, the audit strategy defined in measure (c)1.
Date: Following completion of measure (c)1. onwards.
(d) Not to supply water for regulation 4(1) purposes from Monmouth Treatment Works or Court Farm Treatment Works, or not to so supply unless the specified conditions below are satisfied:
- Not applicable.
(e) To provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risks:
- Provide a progress report annually.
Date: by 31 January each year. - Submit a report on the outcome of the review for GAC treatment and EBCT for step b(1). Provide a copy of the updated policy document.
Date: 30 April 2024 - Confirm solution to mitigate the risks from pollution, pesticides and taste and odour in the raw water source at Monmouth treatment works, as specified in step b(2).
Date: 30 April 2025 - Submit a report on the planning, design and procurement arrangements for the agreed solution at Monmouth treatment works, as specified in step b(3).
Date: 30 April 2026 - Confirm the construction, installation and commissioning of the agreed solution at Monmouth treatment works, as specified in step b(4).
Date: 30 April 2028 - Confirm staff are fully briefed and trained in operating new or modified process stages, as specified in step b(5).
Date: 30 April 2028 - Confirm solution to mitigate the risks from pollution, pesticides and taste and odour in the raw water source at Court Farm treatment works, as specified in step b(6).
Date: 30 April 2024 - Submit a report on the planning, design and procurement arrangements for the agreed solution at Court Farm treatment works, as specified in step b(7).
Date: 30 April 2025 - Confirm the construction, installation and commissioning of the agreed solution at Court Farm treatment works, as specified in step b(8).
Date: 30 April 2026 - Confirm staff are fully briefed and trained in operating new or modified process stages, as specified in step b(9).
Date: 30 April 2026 - Submit the audit strategy for auditing the effectiveness of the measures, as specified in measure (c)1.
Date: 31 January 2024 - Submit any revisions of the audit strategy produced under measure (c)2.
Date: Within 1 month of a revision - Submit a report in the event that any completed measures of this Notice need to be altered in any way, for any reason.
Date: Ongoing for the duration of this notice. - Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with Board level Director sign-off.

Further Details of this Notice:
- Any product or substance used as a result of the requirements in this Notice must comply with regulation 31.
- Under regulation 28(6) the Inspectorate, on behalf of the Welsh Ministers, may by notice served on the Company, revoke or vary this Notice.
- Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991 (as amended).
