Water undertaker as appointed under section 6 of the Water Industry Act 1991 (as amended): Southern Water Services Limited, with registered number 02366670 (hereinafter called ‘the Company’).

  • RI014 Cooks Castle Shanklin WSR

Details of this Notice:

  1. The Drinking Water Inspectorate (‘the Inspectorate’) has received a regulation 28(1) report of the Water Supply (Water Quality) Regulations 2016 (as amended) (‘the Regulations’) from the Company dated 31 January 2022, which states that there is or has been a significant risk of supplying water from Cooks Castle Shanklin WSR (and associated assets as applicable) that could constitute a potential danger to human health or could be unwholesome.
  2. Consequently, this Notice is served on the Company by the Inspectorate on behalf of the Secretary of State, under regulation 28(4) for the assets listed above, for risks associated with:

  1. The Company are required to satisfy the following requirements.

The date given is that until or by which the requirements must be maintained or satisfied, as appropriate.

Requirements:

(a) To maintain the following measures for the period specified in each case:

  1. Operation of Cooks Castle Shanklin WSR in accordance with Company policy, procedures and to internally agreed process parameters.

  2. Ongoing monitoring of regulatory and operational sample results and online data.
    Date: Ongoing for the duration of this Notice
  3. Enhanced large volume sampling and enhanced data assessment at frequency set out in audit strategy.

  4. Weekly site security and inspection visits.
    Date: Ongoing for the duration of this Notice
  5. Quarterly visits to complete Water Supply Checklist Inspection.

  6. Monitor and track trends for customer contacts in downstream water supply zones.

  7. Investigate any reports of illness contacts in downstream water supply zones.

  8. Proactive management of Cooks Castle Shanklin WSR and network to minimise risk of ingress.

  9. Continue ground movement and ground water monitoring.

  10. Carry out Remote Operated Vehicle (ROV) surveys at frequency set out in audit strategy

(b) To review, revise or make operational the following measures, by the dates specified in each case:

  1. Confirm the contingency plan to remove Cooks Castle WSR from supply in the event of an emergency. Plan to include definition of emergency.

  2. Following completion of remedial works at Carisbrooke WSW, confirm the short-term plan to remove Cooks Castle WSR from supply for inspection and clean.

  3. Complete the internal inspection, flood test and clean of Cooks Castle WSR

  4. Confirm the scope of remedial works where necessary and as required to bring Cooks Castle WSR back into supply or confirm that Cooks Castle WSR will remain out of supply.

  5. Confirm the scope of the proposed medium-term improvement works following the inspection of Cooks Castle WSR to maintain resilient supplies to customers supplied from Cooks Castle WSR and timescales for delivery.

  7. Confirm the scope of the proposed long-term works, including the location of any land purchases required and timescales for delivery of the solution to permanently remove Cooks Castle WSR from supply.

  8. Confirm the delivery and realisation of benefit of use from the long-term permanent solution to replace Cooks Castle WSR as outlined in (b)7.
    Date: 28 February 2028
  9. Confirm handover of the new assets in accordance with Southern Water’s commissioning process.

(c) To audit whether the measures have been effective by the following means:

  1. Define an audit strategy to monitor the effectiveness of the measures specified in sections (a) and (b).

  2. Implement, and keep under continuous review, the audit strategy defined in measure (c)1.
    Date: Following completion of measure (c)1. onwards.

(d) Not to supply water for regulation 4(1) purposes from Cooks Castle Shanklin WSR, or not to so supply unless the specified conditions below are satisfied:

(e) To provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risks:

  1. Provide a progress report annually.

  2. Submit a report confirming the plan to remove Cooks Castle WSR from supply in the event of an emergency. Plan to include definition of emergency.

Further Details of this Notice:

  1. Any product or substance used as a result of the requirements in this Notice must comply with regulation 31.
  2. Under regulation 28(6) the Inspectorate, on behalf of the Secretary of State, may by notice served on the Company, revoke or vary this Notice.
  3. Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991 (as amended).
