NOTICE UNDER REGULATION 28(4)

ANGLIAN WATER: CANDLESBY WATER TREATMENT WORKS

THE SECRETARY OF STATE:

  1. has received a report from Anglian Water (the “company”) dated 1 January 2021 (the “Report”) which states that there is or has been a significant risk of supplying water from Candlesby WTW that could be unwholesome.
  2. GIVES NOTICE to the company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Taste

Requirements

(a) to maintain the following measures for the period specified [in each case]:

  1. Regular review and update of groundwater risk assessments.
    Date: Ongoing for the duration of the notice
  2. Carry out enhanced (weekly) monitoring for taste at Candlesby WTW final water monitoring point.
    Date: Ongoing for the duration of the notice
  3. Carry out enhanced (weekly) monitoring at Welton Le Marsh source and Candlesby final water point, for parameters linked to the taste detections, this is to include:
    • sodium
    • conductivity
      Date: Ongoing for the duration of the notice chloride
  4. Carry out enhanced (weekly) monitoring at Welton Le Marsh source for additional parameters to monitor the effect on water quality of minimising the use of borehole 3. This is to include potassium, sulphate, fluoride, alkalinity, calcium, magnesium, nitrate and pH.
    Date: Ongoing for the duration of the notice
  5. Continue to undertake continuous online monitoring for conductivity at each borehole in both the Welton Le Marsh and Candlesby sources.
    Date: Ongoing for the duration of the notice
  6. Continue to undertake continuous online monitoring for conductivity at Candlesby WTW on the combined filter outlet.
    Date: Ongoing for the duration of the notice
  7. Continue to investigate any ‘saline’, ‘bitter’ or otherwise unusual taste detections at Candlesby WTW final water point.
    Date: Ongoing for the duration of the notice
  8. Report any ‘saline’, ‘bitter’ or otherwise unusual taste detections from Candlesby WTW final water to the Inspectorate.
    Date: Ongoing for the duration of the notice
  9. Continue to operate the boreholes feeding into Candlesby WTW to minimise the risk of the final water having elevated conductivity.
    Date: Ongoing for the duration of the notice
  10. Continue to monitor customer contacts in the Skegness Public Water Supply Zone (PWSZ) for any reports of ‘bitter’ or ‘salty’ tastes and undertake further investigations as required.

  11. Report any saline’ or ‘bitter’ taste detections from Skegness Public Water Supply Zone (PWSZ) to the Inspectorate.

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Minimise the need for Welton Le Marsh borehole 3, by changing the control philosophy at Candlesby WTW.
    Date: Completed
  2. Monitor the effects of these controls on the water quality via the enhanced monitoring sample results. Report analysis results weekly to a defined group, for timely identification of any trends or actions required.
    Date: Ongoing
  3. Undertake groundwater survey and logging of Welton Le Marsh borehole 3 to identify if there are any actions or maintenance required within the borehole column.
    Date: 30 April 2021
  4. Identify any additional long-term strategies to reduce the risk of any future taste detections in this area.
    Date: Ongoing

(c) to audit whether the measures have been effective by the following means:

  1. Define and keep under continuous review an audit strategy to monitor the effectiveness of the above measures.

  2. Implement, and keep under continuous review, the audit strategy defined in measure (c)1.
    Date: Following completion of measure (c)1, onwards

(d) not to supply water for regulation 4(1) purposes from Candlesby WTW unless the conditions specified below are satisfied:

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress report annually by 31 January and against the following milestones:

    • Submission of the audit strategy
      Date: 30 April 2021
  2. Submit a report in the event that any completed measure of this Notice needs to be altered in any way for any reason.
    Date: Ongoing for the duration of this Notice
  3. Review the risk assessment for Candlesby WTW as required by regulation 27(3) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: From time to time and by 21 May 2022
  4. Submit a satisfactory completion report.
    Date: 31 May 2022

Failure by the company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991. [Further contravention of the regulation 28(4)(d) requirement in this Notice is an offence and a person guilty of the offence shall be liable on conviction to a fine].
