THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2018

NOTICE UNDER REGULATION 28(4)

DWR CYMRU WELSH WATER: PENGARNDDU SRV

THE WELSH MINISTERS:

1) has on 27 September 2018 received a report from Dwr Cymru Welsh Water (the “Company”) dated 27 September 2018 (the “Report”) which states that there is or has been a significant risk of supplying water from Pengarnddu SRV that could be unwholesome.
2) GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2018 that it must satisfy the following requirement:

For risks associated with:

  • Potential loss of supply
  • Turbidity
  • Iron
  • Manganese

Requirements

(a) to maintain the following measures for the period specified in each case:

  1. Regulatory and operational monitoring at Pontsticill WTW, Pengarnddu SRV and at customer taps in the distribution zone
    Date: ongoing for the duration of the Notice
  2. Utilisation of Pengarnddu SRV by-pass as an emergency option
    Date: ongoing for the duration of the Notice
  3. Planning of WTW outages to minimise impact on customers
    Date: ongoing for the duration of the Notice
  4. Implementation of robust risk mitigation/emergency contingency plans for any unplanned works outage
    Date: ongoing for the duration of the Notice
  5. Monitoring, tracking and reporting customer contacts
    Date: ongoing for the duration of the Notice
  6. Responding and escalating as required to any PCV failure or customer contacts in line with company procedures.
    Date: ongoing for the duration of the Notice
  7. Undertake an investigation to determine the root cause of the failure and identify any remedial measures required to prevent a recurrence, including enhanced monitoring.
    Date: ongoing for the duration of the Notice
  8. Liaison with local and public health authorities with any issues that impact on public health within the supply system and as appropriate
    Date: ongoing for the duration of the Notice
  9. Review risk assessments and update regulation 28 report
    Date: ongoing for the duration of the Notice

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Supplement flow from Nantybwch WTW to extend storage at Pengarnddu SRV
    Date: COMPLETE
  2. Increase storage capacity at Pengarnddu by 9Ml
    Date: 30 September 2022

(c) to audit whether the measures have been effective by the following means:

  1. Monitor occasions where outage at Pontsticill WTW has resulted in risk of or actual loss of supply or customer acceptability issues.
    Date: Ongoing and for the duration of the Notice and for one year following the completion of the measure in (b)2.

(d) not to supply water for regulation 4(1) purposes

Not applicable

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

Provide a progress report annually by 31 January and against the following milestones:

  1. Confirmation and delivery of the measure in (b)1.
    Date: COMPLETE
  2. Confirmation and delivery of the measure in (b)2.
    Date: 31 October 2022
  3. Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with Board level Director sign-off.
    Date: 31 October 2023

Failure by the company to comply with this Notice may result in enforcement proceedings under section 18 of the Act.
