NOTICE UNDER REGULATION 28(4)

Northumbrian Essex and Suffolk Water: Regulation 26 Monitor Upgrades

THE SECRETARY OF STATE:

  1. has received a report from Northumbrian Water (the “Company”) dated May 2019 (the “Report”) which states that there is or has been a significant risk of supplying water from the above named treatment works that could be unwholesome.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Disinfection
  • Online monitoring

Requirements

(a) to maintain the following measures for the period specified:

  1. To ensure that wholesome water is supplied to consumers at all times, in accordance with the requirements of Regulation 4 and 26.

  2. Alarms and failsafe shutdown systems are operational and that online instruments (including flow metres) are calibrated and validated at the predefined frequencies.

  3. Continuous turbidity, pH and chlorine residual monitoring is maintained on sites in addition to regulatory compliance sampling.

  4. Appropriate disinfection training and response procedures for all operational staff.

  5. Visual inspection, maintenance and operator site tasks are completed at the appropriate predefined frequencies.

  6. Reactive maintenance response procedures are upheld and teams are supported by appropriate standby resource to ensure an efficient and robust response.

  7. Equipment selection and replacement parts are selected using robust procurement procedures including quality and validation checks where appropriate.

  8. Uninterruptible power supply (battery backup power).

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Tosson treatment works: Install new Regulation 26 turbidity monitor with degasser to prevent air-locking.
    Date: COMPLETE
  2. Honey Hill treatment works: Relocate the Regulation 26 turbidity monitor to a suitable upstream of the chlorine gas dosing point to reduce the risk of air-locking.
    Date: 30 November 2021
  3. Lartington treatment works: Install a dedicated Regulation 26 turbidity monitor sample line and sample pump to prevent interruption during emergency hypochlorite testing and sample pump change over.
    Date: 31 October 2021

(c) to audit whether the measures have been effective by the following means:

  1. Define and keep under continuous review an audit strategy to monitor the effectiveness of the above measures.

  2. Implement the audit strategy defined in (c)1.
    Date: For the duration of the Notice.

(d) not to supply water for regulation 4(1) purposes

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress update annually by 31 January and against the following milestones:
    Date: Annually on 31 January until revocation of Notice
    • Installation progress
    • Monitor performance observed following installation
  2. Review the risk assessment for all sites named as required by regulation 27(3) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.

  3. Submit a satisfactory completion report.
    Date: 31 December 2022

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991.
