Details of this notice:

  1. The Drinking Water Inspectorate(‘the Inspectorate’)has received a set of regulation 28(1) report of the Water Supply (Water Quality) Regulations 2016 (as amended) (‘the Regulations’) from the Company on 18October 2019, which state that there is or has been a significant risk of supplying water from the sites listed water treatment works(and associated assets as applicable) that could constitute a potential danger to human health or could be unwholesome.
  2. Consequently, this Notice is served on the Company by the Inspectorate on behalf of the Secretary of State, under regulation 28(4) for the assets listed above, for risks associated with;

Description of Risk

Hydrocarbons (including volatile organic compounds)

Point source pollution 

Requirements

  1. The Company are required to satisfy the following:

(a) to maintain the following measures for the period specified:

  1. Enhanced routine sampling for hydrocarbon sat appropriate locations.
    Date: Ongoing for the duration of the Notice
  2. Monitor and investigate consumer contacts related to hydrocarbon taste and odour.
    Date: Ongoing for the duration of the Notice
  3. Continuation of initiatives to reduce the risks from domestic oil tanks.
    Date: Ongoing for the duration of the Notice
  4. Review and respond appropriately to mitigate the risk from hydrocarbons from pollution incidents, including those reported through the Environment Agency’s alerts.
    Date: Ongoing for the duration of the Notice

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Install and commission Volatile Organic Compounds(VOC) online monitors at the Water Treatment Works listed in this Notice. These monitors must be:
    Date: 31 December 2022
    • Linked to appropriate alarms and integrated failsafe shutdown mechanisms that have been tested; and
    • Positioned at appropriate locations to protect Company assets from hydrocarbon contamination.
  2. Design and operate a system of verification and maintenance for the VOC monitors installed under measure (b)1.
    Date: 31 December 2022
  3. Update the site operating manuals and procedures, as appropriate, following the installation of the VOC monitors under measure (b)1.
    Date: 31 December 2022
  4. Ensure all relevant staff are trained appropriately in the operation of the VOC monitors installed under measure (b)1.
    Date: 31 December 2022

(c) to audit whether the measures have been effective by the following means:

  1. Define an audit strategy to monitor the effectiveness of the above measures.
    Date: Complete
  2. Implement and keep under continuous review the audit strategy defined in (c)1. above.
    Date: For the duration of the Notice

(d) not to supply water for regulation 4(1) purposes from the sites listed, or not to so supply unless the specified conditions below are satisfied:

  1. Not applicable

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risks:

Provide a progress report annually by 31 January and against the following milestones:

  1. Submit the strategy for auditing the effectiveness of the measures, as specified in (c)1
    Date: Complete 
  2. Submit any revisions of the audit strategy produced under measure (c)2.  
    Date: Within 1 month of a revision 
  3. Submit a report in the event that any completed measure of this Notice needs to be altered in any way for any reason. 
    Date: Ongoing for the duration of this Notice 
  4. Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with Board level Director sign-off. 
    Date: 28 February 2023 

Further details of this notice

  1. Any product or substance used as a result of the requirements in this Notice must comply with regulation 31.  
  1. Under regulation 28(6) the Inspectorate, on behalf of the Secretary of State, may by notice served on the Company, revoke or vary this Notice.  
  1. Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991 (as amended).
