NOTICE UNDER REGULATION 28(4) OF THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016 (AS AMENDED)

Water undertaker as appointed under section 6 of the Water Industry Act 1991 (as amended): Severn Trent Water Limited, with registered number 02366686 (hereinafter called ‘the company’).
Assets affected:
T0172 Bamford WTW
- The Drinking Water Inspectorate (‘the Inspectorate’) has received a regulation 28(1) report of the Water Supply (Water Quality) Regulations 2016 (as amended) (‘the Regulations’) from the company dated 4 May 2021, which states that there is or has been a significant risk of supplying water from Bamford WTW (and associated assets as applicable) that could constitute a potential danger to human health or could be unwholesome.
- Consequently, this Notice is served on the company by the Inspectorate on behalf of the Secretary of State, under regulation 28(4) for the assets listed above, for risks associated with:

- The Company are required to satisfy the following:
Requirements
(a) to maintain the following measures for the period specified in each case:
- Ensure an electrician will be on site for any power switching activities.
Date: Ongoing for the duration of this notice. - Optimisation of existing process to prevent improperly disinfected water from leaving the treatment works.
Date: Ongoing for the duration of this notice. - Review and optimisation of the existing water quality alarms.
Date: Ongoing for the duration of this notice. - Continue to operate the treatment works in accordance with company procedures.
Date: Ongoing for the duration of this notice. - Appropriate and timely samples in the event of any water quality issues.
Date: Ongoing for the duration of this notice.
(b) to review, revise or make operational the following measures, by the dates specified in each case:
- Automation of DAF Stream 1 and 2 outlet valve/penstocks to enable manual instigation of DAF outlet shutdown from the control room.
Date: 31 July 2023 - Install additional Uninterruptible Power Supply (UPS) at the filtration stage.
Date: 31 December 2021 - Provide a contingency plan to cover all scenarios and prevent the supply of improperly disinfected water.
Date: 31 August 2021 - Complete the detailed design of the treatment works resilience scheme, to include;
- New failsafe system
- Run to waste system
- Third contact tank
- Division of works into two independent treatment streams.
Date: 31 January 2022
- Complete the installation and commissioning of the resilience scheme as designed in step (b)2 above.
Date: 28 February 2025 - Update the treatment works policies and procedures to reflect the changes made to the treatment works, including providing any relevant additional training to staff, based on the changes made.

(c) to audit whether the measures have been effective by the following means:
- Define an audit strategy to monitor the effectiveness of the measures specified in section (a) and (b).
Date: 06 December 2021 - Implement, and keep under continuous review, the audit strategy defined in measure (c)1.

(d) not to supply water for regulation 4(1) purposes from Bamford WTW, or not to so supply unless the specified conditions below are satisfied:

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risks:
- Provide a progress report annually by 31 January and against the following milestones:
Date: Annually by 31 January- Provide a report on the completion of the automation of DAF Stream 1 and 2 outlet valve/penstocks to enable manual instigation of DAF outlet shutdown from the control room completed for measure (b)1.
Date: 31 August 2023 - Provide a report on the installation of the UPS at the filtration stage.
Date: 31 January 2022 - Provide a report on the contingency plan as designed in step (b)2 above.
Date: 30 September 2021 - Provide a report on the completed resilience scheme design as specified in (b)3 above.
Date: 28 February 2022 - Provide a report confirming completion of all work and associated commissioning and training.
Date: 31 March 2025
- Provide a report on the completion of the automation of DAF Stream 1 and 2 outlet valve/penstocks to enable manual instigation of DAF outlet shutdown from the control room completed for measure (b)1.
- Submit the strategy for auditing the effectiveness of the measures, as specified in (c)1.
Date: 06 January 2022 - Submit any revisions of the audit strategy produced under measure (c)2.
Date: Within one month of a revision - Submit a report in the event that any completed measure of this Notice needs to be altered in any way for any reason.
Date: Ongoing for the duration of this Notice - Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with Board level Director sign-off.
Date: 31 March 2026
- Any product or substance used as a result of the requirements in this Notice must comply with regulation 31.
- Under regulation 28(6) the Inspectorate, on behalf of the Secretary of State, may by notice served on the company, revoke or vary this Notice.
- Failure by the company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991(as amended).
