NOTICE UNDER REGULATION 28(4) OF THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016 (AS AMENDED)

Water undertaker as appointed under section 6 of the Water Industry Act 1991 (as amended): Severn Trent Water Limited, with registered number 02366686 (hereinafter called ‘the Company’).
Assets affected:
ZDB01 Peak District Water Supply Zone
- The Drinking Water Inspectorate (‘the Inspectorate’) has received a regulation 28(1) report of the Water Supply (Water Quality) Regulations 2016 (as amended) (‘the Regulations’) from the Company dated 31 January 2014 and 24 February 2015, which states that there is or has been a significant risk of supplying water from ZDB01 Peak District Water Supply Zone (and associated assets as applicable) that could be unwholesome.
- Consequently, this Notice is served on the Company by the Inspectorate on behalf of the Secretary of State, under regulation 28(4) for the assets listed above, for risks associated with:

- The Company are required to satisfy the following:
Requirements
(a) to maintain the following measures for the period specified in each case:
- Regulatory sampling from the Bamford works and in the ZDB01 Peak District water supply zone.
Date: Ongoing for the duration of this Notice - Operate Bamford works within the operational limits for the discolouration parameters.
Date: Ongoing for the duration of this Notice - Respond as required to any PCV failure of customer contact in line with company procedures. Carry out an investigation to determine the root cause of the failure and identify any remedial measures required to prevent recurrence.
Date: Ongoing for the duration of this Notice - Record and monitor customer contacts at appropriate detail.
Date: Ongoing for the duration of this Notice - Mains rehabilitation programme where required.
Date: Ongoing for the duration of this Notice - Mains cleaning programme as directed by the outputs of the discolouration risk assessment.
Date: Ongoing for the duration of this Notice - Localised flushing plans as short-term mitigation measures.
Date: Ongoing for the duration of this Notice - Use and ongoing maintenance of Pressure Reducing Valves to minimise pressure variations across the zone.
Date: Ongoing for the duration of this Notice - Distribution contingency plans and compliance with risk and contingency processes for planned and reactive network interventions.
Date: Ongoing for the duration of this Notice - Maintain a prioritised programme of service reservoir inspection and cleaning.
Date: Ongoing for the duration of this Notice - Liaison with local and public health authorities as appropriate.
Date: Ongoing for the duration of this Notice - Review and update as necessary the regulation 27 risk assessment and regulation 28 report for ZDB01 Peak District water supply zone on a monthly basis and advise DWI of any changes in risk.

(b) to review, revise or make operational the following measures, by the dates specified in each case:
- Review of risk following completion of mains cleaning in 2014/15 cleaning programme.
Date: Complete - Assess mains cleaning requirement as directed by output of discolouration risk assessment (2016/17 programme).
Date: Complete - Complete mains cleaning in line with the outputs of the discolouration risk assessment.
Date: Complete - Review the success of the flushing programme.
Date: Complete - Make operational and maintain the medium-term measures listed by the date specified:
- Conduct an annual review of discolouration risk and completion of further mains cleaning/refurbishment in subsequent financial years should the defined measures of success not be met.

- Conduct an annual review of discolouration risk and completion of further mains cleaning/refurbishment in subsequent financial years should the defined measures of success not be met.
- Make operational and maintain the longterm measures listed by the date specified:
- Develop a plan with timescales for delivery of the mains replacement to reduce discolouration risk in ZDB01 Peak District water supply zone.
Date: 31 December 2021 - Implement the remedial measures defined in the chosen solution to reduce the discolouration risk in ZDB01 Peak District water supply zone.
Date: 31 December 2022
- Develop a plan with timescales for delivery of the mains replacement to reduce discolouration risk in ZDB01 Peak District water supply zone.
(c) to audit whether the measures have been effective by the following means:
- Define an audit strategy to monitor the effectiveness of the measures specified in section (a) and (b). To include:
Date: Complete- An enhanced sampling programme to include 104 samples per year for the iron, manganese and turbidity across the water supply zone.
- Record customer contact and complaint data in sufficient detail (including during events) to enable spatial and temporal analysis.
- Review of water quality operational and compliance data, event evidence and customer contact data Implement the audit strategy outlined in (c)1.

(d) not to supply water for regulation 4(1) purposes from ZBD01 Peak district Water Supply Zone, or not to so supply unless the specified conditions below are satisfied:

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risks:
- Provide a progress report annually by 31 January and against the following milestones:
Date: Annually by 31 January- Submit an Action Plan detailing the audit strategy and how success will be measured, demonstrated and sustained, as defined in (c)1. The strategy should include the criteria to determine the success of the flushing programme and whether longer term interventions are required to mitigate the risk.
Date: Complete - Provide a report detailing the effectiveness of the mains flushing in the water supply zone.
Date: Complete - Submit a report detailing the chosen solution for mitigating the risk of discolouration in the ZDB01 Peak District water supply zone and provide the plan with timescales for delivery of the chosen solution.
Date: 31 January 2022 - Confirm completion of the implementation of the remedial measures from the chosen solution for mitigating the risk of discolouration in the ZDB01 Peak District water supply zone.
Date: 31 January 2023
- Submit an Action Plan detailing the audit strategy and how success will be measured, demonstrated and sustained, as defined in (c)1. The strategy should include the criteria to determine the success of the flushing programme and whether longer term interventions are required to mitigate the risk.
- Submit any revisions of the audit strategy produced under measure (c)2.
Date: Within 1 month of a revision - Submit a report in the event that any completed measure of this Notice needs to be altered in any way for any reason.
Date: Ongoing for the duration of this Notice - Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with Board level Director sign-off.

- Any product or substance used as a result of the requirements in this Notice must comply with regulation 31.
- Under regulation 28(6) the Inspectorate, on behalf of the Secretary of State, may by notice served on the Company, revoke or vary this Notice.
- Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991(as amended).
