NOTICE UNDER REGULATION 28(4)

THE SECRETARY OF STATE:
- has received a report from South East Water (the “Company”) dated 1 November 2017 (the “Report”) which states that there is or has been a significant risk of supplying water from Woodgarston works that could constitute a potential danger to human health.
- GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 that it must satisfy the following requirement:
For risks associated with:
- Nitrate
Requirements
(a) to maintain the following measures for the period specified in each case
Date: Until new treatment is installed and commissioned.
- Management of the borehole usage. Borehole No.1 is not in use due to the elevated nitrate concentrations.
- The company will confirm that arrangements for blending are consistent with current industry best practice and all Drinking Water Inspectorate guidance and requirements of the regulations.
- The company will evaluate and determine the most suitable method to blend the source waters to reduce the nitrate concentration in the final water accordingly to ensure compliance with the regulations.
- Weekly water sampling of borehole and final waters for nitrate.
(b) to review, revise and/or make operational the following measures, by the date specified below:
- Installation of Nitrate removal treatment at Woodgarston WTW.
Date: By 31 December 2021 - Continuation of catchment management working with stakeholders to reduce input from sources, understand activities contributing to nitrate in catchment and put in place and maintain appropriate mitigations for areas at high risk.
Date: For the duration of the notice - An appropriate maintenance regime for the nitrate removal plant.
Date: 31 December 2021 - Put in place training and associated procedures for ensuring the ongoing competence of staff charged with operating, maintaining and repairing the nitrate removal plants.
Date: 31 December 2021
(c) to audit whether the measures have been effective by the following means:
- Define a strategy for auditing the effectiveness of the measures made operational above. To include:
Date: For the duration of the notice- Pre-completion of the treatment solution sampling at a weekly frequency of the raw and treated water for Nitrate.
- Post-completion of the treatment solution sampling at a weekly frequency of the raw, post-nitrate removal stage and blended final water for Nitrate.
(d) N/A
(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:
- Provide a progress report against the following milestones:
- Provide a report regarding the audit strategy defined in (c)1.
Date: 31 July 2019 - Following completion of the installation of the nitrate removal process in (b)1, maintenance regime in (b)3 and training procedure in (b)4.
Date: 31 January 2021
- Provide a report regarding the audit strategy defined in (c)1.
- Review the risk assessment for Woodgarston supply system (Y230) as required by Regulation 27(4) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
Date: 31 January 2022 - Submit a satisfactory completion report

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Act.
