THE SECRETARY OF STATE:

  1. has on 11 September 2018 received a report from SOUTH STAFFS WATER (the “Company”) dated 11 September 2018 (the “Report”) which states that there is or has been a significant risk of supplying water from Hampton Loade and Seedy Mill distribution networks that could be unwholesome.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Customer acceptability contacts
  • Disinfection by products

Requirements

(a) to maintain the following measure[s] for the period specified [in each case]

  1. Operation of Hampton Loade and Seedy Mill WTW in accordance with Company policy, procedures and to internally agreed process parameters.
    Date: for duration of notice
  2. Operation of network to minimise DBP and customer acceptability contacts.
    Date: for duration of notice
  3. Ongoing monitoring of regulatory and operational sample results, on line data including disinfectant levels and reported customer contacts.
    Date: for duration of notice

(b) to [review, revise and/or make operational] the following measure[s], by the date specified below:

  1. Confirm the timetable and programme for the strategic mains cleaning activity
    Date: By end March 2022
  2. Complete the planning, design, procurement and enabling works for the strategic mains cleaning programme
    Date: By end April 2023
  3. Deliver the strategic mains cleaning programme activity to programme as designed
    Date: By end March 2025

(c) to audit whether the measures have been effective by the following means:

  1. Enhanced monitoring for DBP parameters at source and in the network
    Date: For duration of notice
  2. Monitoring and tracking trends for customer acceptability contacts
    Date: For duration of notice

(d) not to supply water for regulation 4(1) purposes from [TREATMENT WORKS OR SUPPLY SYSTEMS] [unless the conditions specified below are satisfied]

  1. N/A

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

Provide a progress report annually by 31 January and against the following milestones:

  1. Confirmation of timetable and programme for the strategic mains cleaning programme
    Date: By end April 2022
  2. Completion of the planning, design, procurement and enabling works for the strategic mains cleaning programme
    Date: By end May 2023
  3. Delivery of the strategic mains cleaning programme activity as designed
    Date: By end April 2025
  4. Review the risk assessment for Hampton Loade and Seedy Mill distribution networks as required by Regulation 27(4) or 28(4) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: By end May 2025
  5. Submit a satisfactory completion report
    Date: By end April 2026

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Act. [Further contravention of the regulation 28(4)(d) requirement in this Notice is an offence and a person guilty of the offence shall be liable on conviction to a fine]1.
