THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016

NOTICE UNDER REGULATION 28(4)

UNITED UTILITIES: SWEETLOVES WTW

THE SECRETARY OF STATE:

  1. Has on 18 October 2016 received a report from United Utilities (the “Company”) dated 24 May 2016 (the “Report”) which states that there is or has been a significant risk of supplying water from Sweetloves WTW that could constitute a potential danger to human health.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 that it must satisfy the following requirements:

For risks associated with the sites programmable logic controller (PLC) and supervisory control and data acquisition system (SCADA) for the following parameters:

  • Coliforms
  • E. coli
  • Turbidity
  • Hydrogen Ion (pH)
  • Colour
  • Metals

Requirements

(a) to maintain the following measures for the period specified

  1. Operation of all processes within defined normal operating ranges with appropriate triggers, responses and contingency procedures.

  2. Critical control points in the treatment process are monitored and protected by alarm via telemetry to the Integrated Control Centre.

  3. WTW process operated to requirements of the Site Disinfection Policy.
    Date: Until revocation of this notice
  4. Compliance and operational data from the WTW and associated WSZs to be reviewed on a regular and routine basis as defined by the company.

  5. Monitor coliforms, E. coli, turbidity, pH, colour, metals chlorine residuals as part of the routine statutory and operational sampling programme at the WTW final compliance point.

  6. Use the Installed “Diagnostic” software to identify PLC failures and take appropriate action to verify the continuing satisfactory treatment of the water and ensure that non-compliant water does not enter supply.

  7. Keep additional hardware critical spares for the unsupported PLC equipment at Sweetloves WTW.

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Upgrade the on-site communication network,

  2. Confirm programme of work required to enable the WTW to be removed from supply for more than 8 hours

  3. Confirm the scope and schedule for the replacement of the PLCs and SCADA as soon as practicable following confirmation of (b)2 above

  4. Complete programme of work required to enable the WTW to be removed from supply for more than 8 hours

  5. Complete remedial work on PLCs and SCADA

(c) to audit whether the measures have been effective by the following means:

  1. Define a strategy for auditing the effectiveness of the measures made operational in (b) above

  2. Implement the audit strategy.

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress report annually by 31 January and against the following milestones:
    • Confirmation of audit strategy.
      Date: Complete
    • Confirm completion of long term measures.
      Date: 31 May 2021
  2. Review the risk assessment for T030 Sweetloves WTW as required by Regulation 27(3) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: 31 July 2021
  3. Submit a satisfactory completion report.
    Date: 13 months following completion

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Act.
