NOTICE UNDER REGULATION 28(4)

Yorkshire Water Services: Multiple zones consumer acceptability

THE SECRETARY OF STATE:

  1. has received a set of reports from Yorkshire Water services Ltd. (the “Company”) dated 1 October 2018 (the “Reports”) which state that there is or has been a significant risk of supplying water from the above listed water quality zones that could be unwholesome.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Discolouration

Requirements

(a) to maintain the following measures for the period specified in each case:

Date: Ongoing for the duration of the notice

  1. Monitoring, tracking and reporting consumer acceptability contacts with appropriate triggers and action levels in line with company procedures
  2. Responding as required to any PCV failure or consumer contact in line with company procedures. Conduct an investigation to determine the root cause and identify remedial measures to prevent a recurrence
  3. Liaison with local and public health authorities as appropriate
  4. Review risk assessments for consumer contacts and update regulation 28 reports.
  5. Continue regulatory monitoring at prescribed frequencies and additionally an enhanced operational monitoring determined by the company based on risk.

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Undertake a study of each of the zones at risk to characterise the source, nature and mitigation measures for discolouration and parameters at risk in each of the zones..
    Date: To be completed by 31January 2020.
  2. Confirm the contribution from trunk main systems on discolouration performance of the zones and confirm necessary mitigation measures
    Date: 28 February 2020 as per step 2 (e)1a.
  3. Confirmation of the programme of work identified and the confirmation of success criteria for demonstration of benefit in delivering the proposed programme of work including commencement dates and timescale for demonstration of benefit.
    Date: 28 February 2020 as per step 2 (e)1a.
  4. Delivery of programme of work as identified through each study as defined in Step (b)3 above.
    Date: By 30 November 2022

(c) to audit whether the measures have been effective by the following means:

Define a strategy for auditing the effectiveness of the above measures in parts (a) and (b) to include the following;
Date: by 28 February 2020 and as required.

  1. Review of consumer contacts on a monthly basis to measure and monitor change and if necessary escalate remediation as appropriate.
  2. DWSP and regulation 28 reports to be updated in line with any new information arising.
  3. Review the programme of work and delivery timescales to address priority areas of customer acceptability following updated information.
  4. Validate benefits delivered against benefits criteria set.

(d) not applicable

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress report annually by 31 January and against the following milestones:
    • a. Provision of the programme of remediation work arising from studies and criteria for benefit setting as indicated in Step (b)3
      Date: One month after completion of the step
    • b. Delivery of remediation identified in Step (b)4.
      Date: By 31 December 2022
    • c. Initial completion report.
      Date: By 31 January 2023
  2. Review the risk assessment for all zones as defined in this notice as required by regulation 27(3) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: From time to time as required and by 21 January 2023
  3. Submit a satisfactory completion report.
    Date: 31 January 2024

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991.
